Agreement Between User and Conquerors

 

Welcome to Conquerors! The Conquerors website (the "Site") consists of various web pages operated by Kevin Institute, Inc. Your access to and use of Conquerors is conditioned on your acceptance of and compliance with the following terms and conditions (the "Terms"). By using Conquerors, you agree to abide by these Terms. We encourage you to read them carefully and keep a copy for your records.

 

Service Overview

 

At Conquerors, we are committed to providing exceptional educational content, personalized support, and a welcoming community to ensure our students thrive. We invite prospective students to carefully consider their commitment to their educational journey before applying. Conquerors is designed for individuals who are ready to dedicate time and effort toward achieving significant results, rather than for those who are merely interested in trying our services. Access to our offerings is limited to members who demonstrate this level of commitment.

 

Privacy

 

Your use of Conquerors is governed by our Privacy Policy. We urge you to review this policy as it explains how we collect and manage your data on the Site.

 

Electronic Communications

 

By visiting Conquerors or sending emails to us, you are engaging in electronic communications. You consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications provided to you in this manner satisfy any legal requirement for such communications to be in writing.

 

Your Account

 

When using this Site, you are responsible for safeguarding your account and password as well as restricting access to your computer. You agree to take responsibility for all activities that occur under your account or password. You accept that Kevin Institute, Inc. (KILL) is not liable for any unauthorized access to your account that results from theft or negligence on your part. KILL reserves the right to refuse or cancel services, terminate accounts, or modify content at our discretion. It is your responsibility to provide accurate and complete information during registration and account management.

 

Membership and Payment

 

Your membership grants access to an exclusive educational server, mentorship opportunities, and a positive networking community. By placing your recurring monthly order with Conquerors, you will be billed $200 initially and then every 30 days thereafter until you decide to cancel your subscription. An electronic receipt will be sent to you following each successful transaction. We accept online payments via Visa, Mastercard, American Express, and Discover cards in USD or any agreed-upon currency. To avoid being charged for the following month, cancellations must be completed before the next billing cycle.

 

Prohibited Transactions

 

KILL will not conduct business or provide services to any countries sanctioned by the Office of Foreign Assets Control (OFAC) in accordance with U.S. and Delaware law.

 

Children Under Thirteen

 

KILL does not knowingly collect personal information from individuals under the age of thirteen. Anyone under 13 may only use Conquerors with the permission of a parent or guardian.

 

Cancellation/Refund Policy

 

You may cancel your membership at any time by logging into your membership portal and updating your preferences. Remember, cancellations should be made before the next billing cycle to prevent charges for the subsequent month. Generally, we do not offer refunds on our products or services due to their digital nature. This policy reflects the significant investment we make in creating and delivering high-quality content. However, we understand that exceptional circumstances may arise, and we encourage you to contact our support team at kevsacepotential@gmail.com if you believe your situation warrants an exception to this policy.

 

Links to Third-Party Sites/Third-Party Services

 

Conquerors may include links to external websites ("Linked Sites"). KILL does not control these sites and is not responsible for their content, updates, or any links contained within them. These links are provided for your convenience; their inclusion does not imply endorsement by KILL. Certain services offered through Conquerors may involve third-party sites and organizations. By using any product, service, or functionality from Conquerors, you acknowledge and consent that KILL may share information and data with third parties to provide the requested services. You are responsible for adhering to the terms of service of any Linked Sites you access.

 

No Unlawful or Prohibited Use/Intellectual Property

 

You are granted a non-exclusive, non-transferable, revocable license to access and use Conquerors in strict accordance with these Terms. By using the Site, you warrant that you will not engage in any unlawful or prohibited conduct. You may not use the Site in any manner that could damage, disable, overburden, or impair it, or interfere with any other user's enjoyment of the Site. You may not attempt to acquire any materials or information through unauthorized means.

All content provided as part of the Service is protected. 

Ownership of Content

The text, graphics, logos, images, and any associated software present on this Site are the exclusive property of KILL or its suppliers and are safeguarded by copyright and various laws that protect intellectual property rights. You agree to respect and adhere to all copyright and proprietary notices contained within this content, and you will not make any modifications to it. You are prohibited from altering, publishing, transmitting, reverse engineering, selling, creating derivative works from, or otherwise exploiting any part of the content found on the Site. The content provided by KILL is not for resale. Your access to the Site does not confer upon you the right to make unauthorized use of any protected content; specifically, you shall not delete or alter any proprietary notices or attribution statements within this content. You may use the protected content solely for your personal, non-commercial purposes and only with KILL's explicit written permission and that of the copyright owner for any other uses. You acknowledge that you do not gain any ownership rights over the protected content by using the Site. Except as specifically allowed by these Terms, no express or implied licenses to any of KILL’s or our licensors’ intellectual property rights are granted to you.

Use of Communication Services

The Site may offer a variety of communication platforms, such as bulletin boards, chat areas, news groups, forums, communities, personal web pages, calendars, and other messaging facilities (collectively "Communication Services") intended to facilitate public interaction or group communication. You agree to use these Communication Services exclusively for posting, sending, and receiving proper messages and materials relevant to the specific Communication Service. By way of illustration, but not limitation, you commit to the following when utilizing a Communication Service:

  • You will not defame, abuse, harass, stalk, threaten, or otherwise infringe upon the legal rights (including privacy and publicity rights) of others.

  • You will not publish or disseminate any content that is inappropriate, profane, defamatory, obscene, indecent, or illegal.

  • You will not upload files containing software or materials protected by intellectual property laws unless you own those rights or have obtained necessary permissions.

  • You will not upload files with viruses, corrupted data, or any harmful software that could damage another’s computer.

  • You will not advertise or sell goods or services for business purposes unless the Communication Service explicitly allows it.

  • You will not conduct surveys, contests, pyramid schemes, or chain letters.

  • You will not download files posted by other users if you know or should reasonably know they cannot be legally distributed.

  • You will not falsify or remove any authorship attribution, legal notices, or proprietary designations from uploaded files.

  • You will not restrict or inhibit any other user’s ability to utilize the Communication Services.

  • You will not violate any applicable codes of conduct or guidelines for any specific Communication Service.

  • You will not harvest personal information, including email addresses, from other users without their consent.

  • You will comply with all relevant laws and regulations.

While KILL is under no obligation to monitor Communication Services, we reserve the right to evaluate posted materials and remove any at our sole discretion. KILL retains the authority to terminate your access to any or all Communication Services at any time without notice and for any reason. We may disclose information as required by law or regulation, and may edit, refuse to post, or remove any content at our discretion. Please exercise caution when sharing personally identifiable information in any Communication Service. KILL does not endorse or take responsibility for the content within these services and disclaims any liability for your participation in them. Managers and hosts of Communication Services are not authorized representatives of KILL, and their opinions do not necessarily reflect those of KILL. Materials uploaded to Communication Services may be subject to specific limitations regarding usage, reproduction, and distribution. If you choose to upload such materials, you are responsible for complying with these limitations.

Materials Provided to KILL

KILL does not claim ownership of the materials you share with us (including feedback and suggestions) or post, upload, input, or submit to any KILL Site or related services (collectively "Submissions"). However, by sharing your Submission, you grant KILL, our affiliates, and necessary sublicensees the right to use your Submission in connection with KILL's operations, including but not limited to the rights to copy, distribute, transmit, publicly display, perform, reproduce, edit, translate, and format your Submission, as well as to associate your name with it. You will not receive compensation for the use of your Submission as described herein. KILL is not obligated to use or post any Submission you provide and may remove it at any time at our discretion.

By submitting, posting, uploading, or otherwise providing your Submission, you affirm that you possess or otherwise have control over all rights associated with your Submission, as outlined in this section. This includes, without limitation, all rights necessary for you to provide, post, upload, enter, or submit the Submission.

 

International Users
 

The Service is administrated and operated by KILL from its offices in the USA. If you access the Service from outside the USA, you are responsible for adhering to all local laws. You agree not to use the KILL Content accessed through Conquerors in any country or manner that violates applicable laws, restrictions, or regulations.

 

Indemnification
 

You agree to indemnify, defend, and keep KILL, its officers, directors, employees, agents, and third parties harmless from any losses, costs, liabilities, and expenses (including reasonable attorney fees) arising from your use or inability to use the Site or services, any user postings you make, your breach of any terms of this Agreement, or your violation of a third party's rights, or applicable laws, rules, or regulations. KILL reserves the right to take over the exclusive defense and control of any issue subject to your indemnification, in which case you will fully cooperate with KILL in asserting any available defenses.

 

Class Action Waiver

 

Any arbitration conducted under these Terms and Conditions will occur on an individual basis, and class arbitrations or class/representative/collective actions are prohibited. The parties agree that claims may only be brought in each party's individual capacity, not as a plaintiff or class member in any supposed class, collective, or representative proceedings, including private attorney general actions. Unless otherwise agreed upon by both you and NEL, the arbitrator will not consolidate multiple claims and may not oversee any form of representative or class proceeding.

 

Liability Disclaimer
 

The information, software, products, and services available on or through the Site may contain inaccuracies or typographical errors. Updates to the information are made periodically, and KILL and/or its suppliers may change or improve the Site at any time. KILL and/or its suppliers make no representations regarding the suitability, reliability, availability, timeliness, or accuracy of the information, software, products, services, and related graphics available on the Site for any purpose. To the fullest extent allowed by applicable law, all such information, software, products, services, and related graphics are offered "as is" without any warranty. KILL and/or its suppliers disclaim all warranties and conditions concerning this information, software, products, services, and associated graphics, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the maximum extent permitted by applicable law, KILL and/or its suppliers will not be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever, including, but not limited to, damages for loss of use, data, or profits arising from or connected in any way with the use or performance of the Site, any delays in or inability to use the Site or related services, the provision or failure to provide services, or any information, software, products, or services obtained through the Site, regardless of the nature of the cause of action, whether in contract, tort, negligence, strict liability, or otherwise, even if KILL or its suppliers have been advised of the possibility of such damages. Because some jurisdictions do not allow exclusions or limitations on liability for consequential or incidental damages, the above limitations may not apply to you. If you are dissatisfied with any portion of the Site or with these Terms of Use, your exclusive remedy is to cease using the Site.

 

Termination/Access Restriction

 

KILL retains the right to terminate your access to the Site and related services or any part thereof at its discretion, without notice. To the fullest extent permissible by law, this agreement is governed by the laws of the State of Delaware, and you consent to the exclusive jurisdiction of Delaware courts for any disputes arising from the use of the Site. Unauthorized use of the Site is prohibited in any jurisdiction that does not enforce all provisions of these Terms, including this section. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and KILL due to this agreement or your use of the Site. KILL's fulfillment of this agreement is subject to legal requirements and processes, and does not limit KILL's rights to comply with governmental, judicial, and law enforcement requests or requirements regarding your use of the Site or information provided to or collected by KILL regarding that use. If any part of this agreement is found to be invalid or unenforceable under applicable law, including, but not limited to, warranty disclaimers and liability limitations, that part will be superseded by a valid, enforceable provision that most closely reflects the original intent, and the remainder of the agreement will continue to be in effect.

This agreement represents the complete understanding between the user and KILL regarding the Site, unless stated otherwise within this document. It supersedes all previous or concurrent communications and proposals, whether they were made electronically, verbally, or in writing. A printed copy of this agreement, as well as any notices issued electronically, will be valid in judicial or administrative proceedings related to this agreement, with the same acceptance and conditions as other business documents and records created and maintained in physical form. The parties expressly agree that this agreement and all related documents will be written in English.

 

Modifications to the Terms

 

KILL retains the right to modify the Terms under which Conquerors is provided, at its sole discretion. The latest version of the Terms will replace any previous editions. KILL encourages users to regularly review the Terms to stay updated on any changes.
